Summary of South Dakota Graduated Licensing Law

South Dakota has a three stage licensing process for minors.
  1. Learner’s License (at least age 15) We recommend our DriverEdToGo Video- to use during the Learner stage. Shows the parent how to teach collision-free driving habits and provides unique teaching tools (mirrors, checklists, videos, audio instruction series, etc.)
  2. Intermediate License (ages 16 - 17)
  3. Regular License (age 17 if has had license at least 6 months)

Instruction Permit
Age 14

Requirements
Pass vision, knowledge, and driving test.

Must hold the valid permit continuously for 180 days or 90 days with completion of approved Department of driver education course.

Restrictions
Licensed driver 18 or older with at least 1 year driving experience in seat next to permit holder.

 
Restricted Minor’s Permit
Age 14

Requirements
Pass vision, knowledge, and driving test.

Complete requirements of Instruction Permit.

Not been convicted of a traffic violation during the past six months prior to obtaining the Restricted Minor’s Permit.

An individual up to age 18 years of age may hold a Restricted Minor’s Permit.

Restrictions
Must have Permit in possession.

May operate vehicle from 6 a.m. to 8 p.m. with the permission of parent or legal guardian; and during the hours of 8 p.m. to 6 a.m. if parent or legal guardian is occupying a seat beside the driver.

 
Operator’s License
At least age 16

Requirements
Pass vision, knowledge, and driving test.

Under 18
Completed requirements of Instruction Permit.

Not been convicted of a traffic violation during the past six months prior to obtaining the Operator’s License.
